Terms of Service

In The Swing is operated by In The Swing Golf LLC, a Delaware limited liability company ("In The Swing," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of www.intheswing.golf and the related tools, pages, and services we provide (together, the "Service").

By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of a charity, business, club, or other organization, you represent that you have authority to bind that organization to these Terms, and "you" includes that organization.

In The Swing is a platform for discovering golf tournaments and for organizers to host them. Organizers can publish an event page, sell registrations and sponsorships, and accept donations. Golfers and supporters can find events, register, and pay.

• We are a platform, not the organizer. Tournaments listed on the Service are created and run by independent organizers. When you register or donate, your transaction is with the organizer, not with In The Swing.
• We are not a charity. In The Swing Golf LLC is a for-profit company. We do not accept charitable donations on our own behalf, and we do not issue tax receipts or donation acknowledgments for payments made to organizers.
• We do not hold your money. Payments are processed by Stripe and settle directly to the organizer's own Stripe account. We receive only our service fee.
• We do not verify organizers' tax status. An organizer may describe itself as a charity or nonprofit, but we do not confirm that status. Whether any payment is tax deductible is between you, the organizer, and your tax advisor.

We may update these Terms from time to time. When we do, we will change the "Last Updated" date above and, for material changes, post a notice on the Service or email account holders. Your continued use of the Service after a change takes effect means you accept the updated Terms.

• You must be at least 18 years old to create an account, make a purchase, or host a tournament.
• You agree to provide accurate information, keep it current, and keep your login credentials secure. You are responsible for all activity under your account.
• Signing in with Google is subject to Google's terms. We receive only the basic profile information Google shares with us.
• You can delete your account at any time from your profile page. See the Privacy Policy for what we keep after deletion.

You agree not to:

• Use the Service for any unlawful purpose.
• Misrepresent who you are, your affiliation with a charity, course, or organization, or the purpose of an event.
• Post content that is false, defamatory, obscene, harassing, or that infringes anyone's rights.
• Interfere with the Service, other users, or organizers, or access the Service by automated means other than a standard browser or search engine crawler.
• Use another person's registration management link without their permission, or attempt to access orders that are not yours.

This section applies when you register for, sponsor, or donate to a tournament through the Service.

• Your contract is with the organizer. The organizer is the seller and merchant of record for every registration, sponsorship, and donation. In The Swing facilitates the transaction and provides the tools.
• Pricing and fees. The organizer sets the price for each ticket, sponsorship, or donation option. A service fee is added at checkout, currently 8% of the organizer's price, which covers In The Swing and card processing. The total shown before you pay is the full amount you will be charged. The service fee is not a donation to the organizer.
• Payment processing. Payments are processed by Stripe. Your card details are sent directly to Stripe and are never stored on our servers. Stripe's terms and privacy policy apply to the payment.
• Guest checkout. You can register without an account by providing your name and email. We will email you a private link to view and manage your registration. Anyone with that link can view and edit your registration details, so keep it private. If you later create an account using the same verified email address, your prior orders will be linked to it.
• Registering other people. When you enter other players (for example, as a team captain) or share their contact details, you represent that you have their permission to do so. If you register a player under 18, you represent that you are their parent or guardian or have that person's consent.
• Donations and sponsorships. Donations and sponsorship payments go to the organizer. The confirmation email from In The Swing and the receipt from Stripe are payment receipts, not tax receipts. Any charitable acknowledgment, and any determination of tax deductibility, is the organizer's responsibility.
• Event changes and cancellations. Organizers are responsible for running their events, including date, venue, format changes, and cancellations. Contact the organizer with questions about an event. We are not responsible for an organizer's failure to hold or deliver an event.

• Each organizer sets their own refund policy, including any deadline before the event. The policy is shown on the registration page before you pay. Refund requests should be made to the organizer.
• Refunds return the organizer's price. The service fee is not refundable except where required by law or where we choose to refund it.
• We may issue refunds at our discretion, for example for duplicate charges, suspected fraud, or an organizer who is unable to fulfill an event, regardless of the organizer's policy.
• Chargebacks. Please contact the organizer, or us at contact@intheswing.golf, before disputing a charge with your card issuer. Disputes are handled between the organizer and the cardholder through Stripe.

This section applies if you apply to host, or host, a tournament on the Service (an "Organizer"). It applies in addition to the rest of these Terms.

• Approval. Hosting requires an approved organizer application. We may approve, decline, or revoke organizer access at our discretion. Listing a tournament that registers on another website is free and does not require a Stripe account.
• Your Stripe account. To accept payments you must connect your own Stripe account. Your use of Stripe is governed by the Stripe Services Agreement and the Stripe Connected Account Agreement. You are the merchant of record: payments settle to your Stripe account, and we never hold your funds. You are responsible for Stripe's processing fees, chargebacks and disputes, refunds beyond the tools we provide, and any negative balance on your account.
• Platform fee. Registrants pay a service fee on top of your price, and we collect our portion of it from each transaction. You keep your full price. We may change the fee with at least 30 days' notice; changes apply to transactions after the effective date. Our fee is not refunded when you refund a registrant.
• Accurate representation. You must describe your organization, event, cause, and beneficiary accurately. If you describe an event as a charity or nonprofit fundraiser, that must be true, and you must have the beneficiary's permission to raise funds on its behalf.
• Legal compliance. You are responsible for complying with all laws that apply to your event and fundraising, including charitable solicitation registration, raffle, sweepstakes, and gaming rules, sales and income tax, and issuing any donation receipts or acknowledgments your donors need. You must have permission from the course or venue to hold your event there.
• Registrant data. Through your dashboard and exports you receive names, contact details, and other information registrants provide, including any optional fields you choose to collect. You are independently responsible for that data. You may use it only to run and communicate about your event, must protect it with reasonable security, must not sell it, and must honor deletion requests. You must comply with privacy and anti-spam laws that apply to you.
• Delivering your event. You are responsible for holding the event as described, communicating changes to registrants, and honoring the refund policy you publish. If you cancel an event, you must refund registrants in accordance with your policy and applicable law.
• Your content. You keep ownership of the text, images, and other content you add to your event page. You grant us a non-exclusive, royalty-free license to display and distribute it to operate and promote the Service, and you represent that you have the rights to everything you upload.
• Taxes. You are responsible for all taxes on amounts you receive. Stripe, not In The Swing, provides any tax reporting forms related to your Stripe account.

We may offer promotions to organizers or registrants, such as a bonus payment after a first event reaches a fundraising goal. Promotions are subject to the conditions stated where they are offered, are limited to one per organizer unless we say otherwise, and require an approved organizer account and a connected Stripe account in good standing to receive any payout. We may modify or end a promotion at any time, and we may withhold a payout where we suspect fraud, abuse, or a breach of these Terms.

• You own the content you post. By posting it, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute it as needed to operate and promote the Service. You are responsible for the legality and ownership of your content.
• The Service, including its design, code, and branding, belongs to In The Swing Golf LLC and its licensors. You may not copy or reuse it except as these Terms allow.
• Course information and photos may come from Google and are subject to Google's terms.
• If you send us feedback or suggestions, we may use them without obligation to you.

The Service relies on third parties, including Stripe for payments, Google for sign-in and course data, and external registration sites for tournaments that register elsewhere. We are not responsible for the content, practices, or availability of any third-party service, and your use of them is subject to their own terms.

Our Privacy Policy explains what information we collect, how we use it, and what we share with organizers and service providers.

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that any event will take place as described, that any organizer is a registered charity, or that any payment is tax deductible.

To the fullest extent permitted by law, In The Swing Golf LLC and its members, officers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Service or any event listed on it. Our total liability for any claim relating to the Service is limited to the greater of (a) the service fees we actually received from your transactions in the 12 months before the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to defend, indemnify, and hold harmless In The Swing Golf LLC and its members, officers, and contractors from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your event, your fundraising, your use of registrant data, or your breach of these Terms or applicable law.

We may suspend or terminate your access to the Service, or unpublish an event, at any time if we believe you have violated these Terms or created risk for us, other users, or organizers. You may stop using the Service at any time and may delete your account from your profile page. Sections that by their nature should survive termination, including payment obligations, content licenses, disclaimers, limitation of liability, indemnification, and governing law, will survive.

• These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules.
• Talk to us first. Before filing a claim, you agree to contact us at contact@intheswing.golf and give us 30 days to try to resolve the issue informally.
• Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. Either party may instead bring an eligible claim in small claims court.
